This Privacy Notice is issued in compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the \"Law\"), its Regulations (the \"Regulations\"), and Regulation (EU) 2016\/679 of the European Parliament and of the Council of April 27, 2016 (known as the \"GDPR\"). <\/p>\n

I. CONTROLLER: The company BLAU LIFE, S.A.P.I. DE C.V., with its registered office at Blvd. Miguel de Cervantes Saavedra 386, Granada, Miguel Hidalgo, 11500 Mexico City, CDMX Mexico, as well as its subsidiary companies, affiliates, or companies within the same business group (hereinafter \"ACUARIO INBURSA\"), is the company responsible for the use and protection of your personal data. In this regard, it informs THE DATA SUBJECT about its personal data processing policies and security measures in accordance with the provisions established in this notice. <\/p>\n

II. PURPOSE OF THE NOTICE: The purpose of this privacy notice is to inform any person who provides their data to ACUARIO INBURSA (hereinafter \"THE DATA SUBJECT\") about the policies followed by ACUARIO INBURSA to collect personal data, carry out correct processing for the primary and secondary purposes established herein, the care measures taken to maintain the confidentiality of your personal data, and the mechanisms made available to address inquiries related to your rights of access, rectification, cancellation, and opposition (known as \"ARCO rights\").<\/p>\n

III. AVAILABILITY OF THE NOTICE: This notice may be presented to THE DATA SUBJECT through printed or digital media, or via telephone, but always prior to the collection of their personal data. This privacy notice will be available in its entirety at all times on the website www.acuarioinbursa.com.mx.<\/p>\n

IV. PERSONAL DATA TO BE COLLECTED: The personal data we collect are as follows: name, nationality, date of birth, address, city and country of residence, telephone number(s), email address, photograph, occupation and company for which you work, social media names (Facebook, Twitter, Instagram, Snapchat, and any other current or future social network), and the banking information of your debit or credit cards, or other forms of payment such as PAYPAL, that have been used by THE DATA SUBJECT for the procurement of products or services offered by ACUARIO INBURSA. <\/p>\n

In the event that THE DATA SUBJECT accesses the website www.acuarioinbursa.com.mx or the profiles of ACUARIO INBURSA on social networks (Facebook, Twitter, Instagram, Snapchat, and any other current or future social network), the following data will also be collected: IP address, type of Internet browser, browsing preferences on our website, and Internet pages visited. If not in agreement with the above, THE DATA SUBJECT may disable cookies and web beacons as established in Section IX, titled \"IX. USE OF COOKIES AND WEB BEACONS.\"<\/p>\n

The protection of the privacy of personal data of minors is especially important for ACUARIO INBURSA. Therefore, as soon as we become aware of personal data of minors, its processing will be carried out at all times in compliance with the guidelines and requirements established in the Law and its Regulations. ACUARIO INBURSA will only allow the purchase of its products or services by minors when these are carried out by their parents or guardians, as the case may be, who must grant their consent for the processing of personal data.<\/p>\n

V. PURPOSES OF THE USE OF YOUR PERSONAL DATA: The personal data collected will be used solely for the purposes described below:<\/p>\n

1 )PRIMARY PURPOSES: The personal data we collect from you will be used for activities that are necessary for the services THE DATA SUBJECT requests, such as the following: <\/p>\n

a) The management of reservations, purchases of products or services, quoting for events, and general customer service.<\/p>\n

b) The identification and access of THE DATA SUBJECT to the facilities of ACUARIO INBURSA where the services are provided.<\/p>\n

c) The provision of customer service through chats, email, telephone, or other means.<\/p>\n

d) The collection, use, management, storage, and creation of a database of clients and persons related to ACUARIO INBURSA, as well as activities aimed at maintaining and updating the database to offer better service.<\/p>\n

e) The billing and collection for products and services offered by ACUARIO INBURSA.<\/p>\n

f) Evaluating the quality of products and services offered by ACUARIO INBURSA.<\/p>\n

g) Compliance with the obligations that ACUARIO INBURSA has contracted with THE DATA SUBJECT.<\/p>\n

2) SECONDARY PURPOSES: <\/p>\n

a) Conducting contests, promotional events, sweepstakes, raffles, and all types of promotional activities organized by ACUARIO INBURSA.<\/p>\n

b) Sending promotional communications related to any product or service available on the website www.acuarioinbursa.com.mx, or to the profiles of ACUARIO INBURSA, as well as sending advertising related to entertainment establishments of companies belonging to the same corporate group, whether via email, messages, social networks, or any current or future digital platform (Facebook, Twitter, Instagram, Snapchat, and any other current or future social network).<\/p>\n

c) Sending promotional communications about special activities organized by ACUARIO INBURSA and\/or by companies belonging to the same corporate group.<\/p>\n

d) Understanding user interests and offering improvements in products and services.<\/p>\n

e) Improving the user experience on the website www.acuarioinbursa.com.mx and on social media profiles. <\/p>\n

In the event that THE DATA SUBJECT expresses disagreement with the use of their personal data for one or more secondary purposes, they must state so at the time of granting their consent. Refusal to use data for secondary purposes shall not be a reason to deny the provision of services and products offered by ACUARIO INBURSA.<\/p>\n

VI. RETENTION PERIOD: Due to the nature of the services offered by ACUARIO INBURSA, personal data will be kept until the date on which THE DATA SUBJECT requests its cancellation or until ACUARIO INBURSA, as part of its database update, considers that such information should be purged as it is no longer necessary for the fulfillment of the purposes established in this notice.<\/p>\n

VII. TRANSFER OF PERSONAL DATA TO THIRD PARTIES: The personal data collected will not be traded, sold, assigned, or transferred in any way for profit to any third party. <\/p>\n

Transfers of personal data made by ACUARIO INBURSA will only be with your prior consent or, without the need for consent, in cases permitted by Law, such as transfers of data to subsidiary companies, affiliates, or companies within the same business group as ACUARIO INBURSA, or when necessary to comply with its legal obligations, such as transfers to Mexican and foreign authorities for the purpose of complying with obligations derived from laws or international treaties. Should ACUARIO INBURSA perform any additional transfer requiring express consent, it will be obtained beforehand. <\/p>\n

VIII. THIRD-PARTY PAGES OR LINKS: THE DATA SUBJECT is informed that any link accessed other than the page www.acuarioinbursa.com.mx is external to ACUARIO INBURSA. Therefore, THE DATA SUBJECT assumes absolute responsibility for reviewing the data processing and confidentiality policies and conditions of the link in question, including but not limited to: payment portals, third-party pages related to services offered by ACUARIO INBURSA, external advertising, as well as any other window or link different from the page www.acuarioinbursa.com.mx.<\/p>\n

IX. USE OF COOKIES AND WEB BEACONS: THE DATA SUBJECT is notified that the website www.acuarioinbursa.com.mx uses cookies and web beacons. Cookies are files automatically downloaded and stored on your computer equipment while browsing an Internet site, which allow the Internet server to remember data about the user and their browsing preferences. Web beacons are images inserted into an Internet site or email that can be used to collect certain data and monitor user behavior on the website or store their IP address. The use of Cookies and\/or Web Beacons is intended to provide a better experience during navigation across different sites, as well as to save information about your access to improve account security, define content preferences, and personalize information based on user interests or tracking online purchases. <\/p>\n

THE DATA SUBJECT may disable the use of cookies and web beacons through the \"help\" button found on the toolbar of most browsers; it will tell you how to avoid accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable all cookies.<\/p>\n

X. DATA PROCESSING OFFICER: THE DATA SUBJECT is informed that ACUARIO INBURSA has a department in charge of handling inquiries related to the use and processing of their personal data, as well as those related to the exercise of their ARCO rights. The head of said department is Mr. Miguel Angel Lopez Lopez, to whom you may direct your inquiries in writing at Blvd. Miguel de Cervantes Saavedra 386, Granada, Miguel Hidalgo, 11500 Mexico City, CDMX Mexico, or by email to the following address: arco@acuarioinbursa.com.mx<\/p>\n

XI. EXERCISE OF ARCO RIGHTS: THE DATA SUBJECT is informed that, in compliance with the provisions of the Law and its Regulations, they have the following rights:<\/p>\n

a) Access: You have the right to request from ACUARIO INBURSA a report on the personal data that was collected, its processing, and the conditions of use. In exercising this right, you may request an electronic copy of said information.<\/p>\n

b) Rectification: You have the right to request that ACUARIO INBURSA correct your personal information if it is outdated, inaccurate, or incomplete.<\/p>\n

c) Cancellation: You have the right to request that your personal data be deleted from the records or databases of ACUARIO INBURSA when it is not being used for the purposes for which it was collected or when its processing does not comply with the principles, duties, and obligations provided for in the regulations.<\/p>\n

d) Opposition: You have the right to request that ACUARIO INBURSA does not use (or stops using) your personal data for specific purposes.<\/p>\n

To exercise these rights, THE DATA SUBJECT must submit, either personally or through a legal representative with specific powers, a written request or email addressed to the personal data processing officer described in the previous section, which must contain the following information:<\/p>\n

i. The name of THE DATA SUBJECT and address or other means to communicate the response to the request;<\/p>\n

ii. Documents proving identity or, where applicable, proper legal representation;<\/p>\n

iii. A clear and precise description of the personal data regarding which any of the aforementioned rights are sought to be exercised;<\/p>\n

iv. Any other element or document that facilitates the location of the personal data;<\/p>\n

v. In the case of rectification requests, the modifications to be made and documentation supporting the request must be provided.<\/p>\n

Any request that does not meet these requirements may be rejected by ACUARIO INBURSA until it is rectified.<\/p>\n

Requests that meet the requirements will be processed within 20 business days following the date the request was received. If the request is granted, ACUARIO INBURSA will make it effective within 15 business days following the date the response was communicated to THE DATA SUBJECT. The periods described herein may be doubled only once when the circumstances of the case justify it.<\/p>\n

If, for any justified cause established in the Law or the Regulations, it is not possible to comply with the request, ACUARIO INBURSA must communicate its total or partial refusal to THE DATA SUBJECT, informing them of the reason for the decision and accompanying it with any relevant evidence.<\/p>\n

XII. REVOCATION OF CONSENT FOR THE USE OF YOUR PERSONAL DATA: THE DATA SUBJECT is informed that they may revoke, in whole or in part, their consent for the use of their personal data if they believe it is being used for purposes other than those for which it was collected. To do so, a request must be submitted in accordance with the requirements, procedure, and timelines established in Section XI, titled \"EXERCISE OF ARCO RIGHTS.\" <\/p>\n

The cancellation of personal data will result in a blocking period, after which the data will be deleted. ACUARIO INBURSA may retain personal data exclusively for the purposes of liabilities arising from the processing. The blocking period will be equivalent to the statute of limitations for actions derived from the legal relationship underlying the processing in terms of the applicable Law. Once the data is cancelled, notice will be given to THE DATA SUBJECT. <\/p>\n

XIII. COMPLIANCE WITH EU GDPR PROVISIONS: In the event that THE DATA SUBJECT is a national or resident of the European Union, they are informed that ACUARIO INBURSA, in compliance with the provisions established by the GDPR, has taken various measures for the protection of their personal data, including the following:<\/p>\n

a. Recognition of additional rights: In accordance with the provisions of the GDPR, ACUARIO INBURSA recognizes the following rights of THE DATA SUBJECT:<\/p>\n

i. Right to restriction of processing: This is the right of THE DATA SUBJECT to obtain from ACUARIO INBURSA the restriction of data processing in the following cases:<\/p>\n

* When the accuracy of the personal data is contested, for a period enabling the verification of its accuracy;
* When the processing is unlawful and THE DATA SUBJECT opposes erasure and requests restriction of use instead;
* When the processing is unlawful and THE DATA SUBJECT opposes erasure and requests restriction of use instead;
* When THE DATA SUBJECT has objected to processing, pending verification whether the legitimate grounds of ACUARIO INBURSA override those of THE DATA SUBJECT. In such cases, ACUARIO INBURSA may only continue processing the personal data with the consent of THE DATA SUBJECT or under one of the exceptions established by Law, the Regulations, or the GDPR.<\/p>\n

ii. Right to data portability: This is the right to receive the personal data concerning them, which they have provided to ACUARIO INBURSA, in a structured, commonly used, and machine-readable format, and to transmit those data to another controller when the processing is carried out by automated means.<\/p>\n

iii. Right regarding automated individual decisions: This is the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or significantly affects them in a similar way, unless it is necessary for the provision of services offered by ACUARIO INBURSA.<\/p>\n

The rights referred to herein may be exercised, where applicable, in accordance with the requirements, procedure, and timelines established in Section XI, titled \"EXERCISE OF ARCO RIGHTS.\" <\/span><\/p>\n

b. Record of processing activities: In accordance with the provisions of the GDPR, ACUARIO INBURSA undertakes to enter into a contract with the data processor identified in Section X, titled \"DATA PROCESSING OFFICER,\" who shall be obliged to maintain a record of the processing activities carried out under their responsibility as established by the GDPR.<\/p>\n

XIV. SUPERVISORY AUTHORITY: THE DATA SUBJECT is informed that, for the handling of any complaint or claim related to this notice that has not been duly addressed by ACUARIO INBURSA within the timeframes and forms established herein, they may appeal to the National Institute for Transparency, Access to Information and Personal Data Protection (by its acronym in Spanish, \"INAI\"). Inquiries to this authority may be directed to the telephone 018008354324, the email atencion@inai.org.mx, or in writing to the address located at: Av. Insurgentes Sur, # 3211, Planta Baja, Colonia Insurgentes Cuicuilco, Delegaci\u00f3n Coyoac\u00e1n, C.P. 04530, Mexico City.<\/p>\n

XV. SECURITY MEASURES: THE DATA SUBJECT is informed that ACUARIO INBURSA will take reasonable organizational and technical security measures to prevent the loss, misuse, alteration, or illegal disclosure of their information and personal data, which we require to be met by the service providers it hires, including services provided by subsidiary companies, affiliates, or companies within the same business group as ACUARIO INBURSA. <\/p>\n

Among the security measures that ACUARIO INBURSA may take to protect your personal information are the following:<\/p>\n

a. Restricting access by its personnel to physical or digital databases where the collected personal data is stored.<\/p>\n

b. The use of keys, passwords, and document encryption for physical and digital files where personal data is kept.<\/p>\n

c. The use of antivirus and firewalls to prevent unauthorized access by hackers.<\/p>\n

d) Any other security measure deemed pertinent.<\/p>\n

In the event of a breach of security measures, ACUARIO INBURSA undertakes to take the necessary steps to assess the impact of the breach and take the measures required to remediate any damage caused to its security system. Where appropriate, ACUARIO INBURSA shall notify THE DATA SUBJECT when it estimates that the breach may cause them any harm.<\/p>\n

XVI. MODIFICATIONS TO THE PRIVACY NOTICE: In the event that for any reason ACUARIO INBURSA makes any change or modification to this Privacy Notice, said changes will be announced on the website www.acuarioinbursa.com.mx, where updates, changes, or modifications suffered by this notice to comply with legal requirements, to offer new products or services, to improve privacy policies, or for any other necessary cause can be consulted. <\/p>\n

XVII. CONSENT: You express your consent for the processing of your personal data in accordance with the terms and conditions of this Privacy Notice, except for any reservations you expressly state. <\/p>\n
